For Apartment Residents
And Guests

Drug-Free and Crime-Free Housing

All Locust Park tenants and their guests must comply with criminal laws established by local, state, and national government pertaining to any form of criminal behavior or activity.

Any form of criminal behavior will not be tolerated, including drug- and gang-related activities.

Policies and rules related to drug and criminal activity are listed in detail farther down on this page.

General Apartment Rules

  1. Office hours are 10:00 AM to 6:00 PM, Tuesday through Saturday.
  2. The managers are Cheryl and John Sievers at 663-6787. The assistant manage is Drew Masters at 593-9754.
  3. Rent is due on the first day of every month. You have a grace period until the 5th of the month. Starting on the 6th, a late charge will be applied of $10 per day. All rent payments must be by money order only. Cash and checks are not acceptable.
  4. Every resident is allowed to park one car in the parking lot. If you have a second vehicle, you may park it in the parking lot on a first-come, first-served basis. Each apartment is limited to a maximum of two vehicles.
    All guests must park in the street, no exceptions. Inoperable motor vehicles parked in the parking lot may be towed. Any vehicle parked in the parking lot without a parking permit will be towed.
    Car repairs, oil changes, or similar work are not allowed in the parking lot.
  5. Laundry rooms are open from 8:00 AM to 10:00 PM, daily.
  6. All residents must discard their trash immediately. Setting trash outside your door for any length of time is prohibited. Place all household trash in the dumpster itself, not in the dumpster area.
    No furniture or tires are to be placed in the dumpster area for disposal.
    We regulate the use of patios and balconies. All balconies and patios must be kept clean and free of all trash and/or junk. Grilling or hanging clothes to dry on patios and balconies is not allowed. Grills must be stored out of sight, and in an orderly manner.
  7. No more than the number of people specified on the lease are allowed to occupy an apartment.
  8. Noise levels must be kept at a minimum at all times. Radios in vehicles must be kept low so other residents are not disturbed.
  9. The pool is open every year from June 1 to September 1, from 11:00 AM to 9:00 PM. Residents are allowed to bring on guest in with them. Children under age 14 must be accompanied by an adult.
    There is no lifeguard on duty. All swimmers swim at their own risk. You must obey the pool rules posted in the pool area. Pool privileges may be revoked if rules are not being followed. Live preservers are for emergency use only. They are not to be used for play.
  10. No storing anything in the garden-level stairways.
  11. No pets are allowed anywhere in the apartment complex — even temporarily. If you, or any guest, or other occupant violates the pet restriction — with or without our knowledge — you will be subject to the charges, damages, eviction, or other remedies provided in the lease contract.
    If a pet has been in the apartment at any time during your period of occupancy, we will charge you for de-fleaing, deodorizing, or shampooing to protect future residents from possible health hazards.
  12. All bicycles must be placed in or by the bike racks.
  13. We clean up the grounds every morning. If toys have been left lying around outside, they will be thrown in the dumpster. Please pick up after your children.
    Strollers must be kept inside your apartment. No furniture is to be left outside. No hanging laundry out on your deck. Keep your deck clean and orderly so it looks nice.
  14. Do not disconnect or take the batteries out of the smoke detectors. You are responsible for checking your fire alarm to make sure the battery works.

Rules Regarding Drug Activity,
And Gang or Other Criminal Behavior

When you lease a Locust Park apartment, you agree to the following policies regarding drug activity, and gang or other criminal behavior:

  1. The Resident, any member of the Resident's household, or any guest or other person under the Resident's control shall not engage in or facilitate criminal activity on or near the rental unit — including, but not limited to, violent criminal activity or drug-related criminal activity as defined in Title 16 and 18, C.R.S. of the Colorado Criminal Code.
    Such criminal activity on or near the premises is defined, but not limited to:
    • Prostitution as defined in Article 7, Title 18, C.R.S.
    • Criminal and gang activity as set forth in Title 16 and 18, C.R.S.
    • Threats or intimidation as prohibited in Title 18, C.R.S.
    • Assault as prohibited in Article 3 of Title 18, C.R.S.
    • Unlawful possession or discharge of firearms or illegal weapons as prohibited in Article 12 of Title 18, C.R.S.
    • or any other violation of the Criminal Statutes of the State of Colorado or any breach of the lease agreement that otherwise jeopardizes the health, safety and welfare of the landlord, their agent, other residents and guests, or that which involves imminent or actual serious property damage.
  2. The Resident, any member of the Resident's household, a guest, or another person affiliated in any way with the Resident shall not permit the dwelling unit to be used for, or facilitate criminal activity, including but not limited to, violent criminal activity or drug-related activity.
  3. "Violent criminal activity" means any felonious criminal activity that has as one of its elements the use, attempted use, or threatened use of physical force against the person or propery of another.
  4. "Drug related criminal activity" means the illegal manufacture, sale, distribution, use, or possession with intent to manufacture, sell or use a controlled substance (as defined in Section 102 of the Controlled Substances Act (21 U.S.C. 802) of the Federal Code and Article 18 of Title 18, C.R.S. of the Colorado Code.
    This restriction further includes the growth, use, or possession of marijuana, regardless of quantity, on or near the premises.
  5. Violation of any section of these drug-activity/criminal-behavior policies constitutes a substantial violation of the lease and a material non-compliance with the lease. Any such violation is grounds for termination of tenancy and eviction from the unit per Article 40-107.5 of Title 13, C.R.S.
    Proof of violation exists by a preponderance of evidence under civil law, unless otherwise provided by law — which means a conviction is not necessary to cause termination of the lease.
  6. In case of any conflict between the provisions of these policies and any other provisions of the lease, the provisions of these policies shall govern.
